These Terms of Service (“Terms”) govern your access to and use of the website www.michellejlamont.com (the “Site”), the Manifesting Miracles Academy and related platforms on Thinkific (manifestingmiracles.thinkific.com), online courses, memberships, live virtual classes, one-on-one coaching (virtual or in-person), in-person retreats, digital products, community forums, live events, and any other services or content provided by Michelle J. Lamont or Manifesting Miracles LLC (“we,” “us,” “our,” or “Coach”) (collectively, the “Services”). By accessing, browsing, registering for, purchasing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate.

2. Services Description The Services include educational and coaching offerings such as:

• Online courses, digital products, pre-recorded content, workbooks, hypnosis journeys, rituals, and on-demand replays (delivered primarily via Thinkific).
• Membership communities and subscriptions (e.g., Manifesting Miracles Academy) providing access to live virtual sessions (typically 4–10 per month), community forums, weekly materials, and replays.
• Group coaching programs and live virtual events.
• Private one-on-one coaching sessions (virtual via video or in-person where specified).
• In-person retreats, workshops, or events at designated locations.

All Services are for personal development, manifestation, spiritual growth, and mindset coaching only. They do not constitute medical, psychological, therapeutic, financial, legal, or professional advice. Consult qualified professionals for such needs. We reserve the right to modify, update, or discontinue any Services at any time.

3. Accounts and Registration Certain Services require creating an account via Thinkific or the Site. You agree to provide accurate, current information, maintain the confidentiality of your credentials, and be responsible for all activity under your account. We may suspend or terminate accounts for violations of these Terms, non-payment, or at our discretion.

4. Payments and Billing All prices are in USD unless otherwise stated. Payments are processed through Thinkific and/or third-party providers. You authorize recurring charges for subscriptions or payment plans. Taxes are not included in listed prices and vary by jurisdiction.

All sales and access are subject to our separate Refund and Cancellation Policy (incorporated herein by reference and available at [link to your Refund Policy page]). Failure to complete payment plan installments may result in suspension or revocation of access without refund. Cancellation stops future charges but does not forgive outstanding balances. We may use reasonable collection efforts for unpaid amounts.

5. Intellectual Property All content in the Services—including videos, audio recordings, materials, frameworks, templates, workbooks, live session content, website text, logos, and community posts (“Content”)—is the intellectual property of Michelle J. Lamont or Manifesting Miracles LLC and protected by United States and international copyright, trademark, and other laws.

Enrollment or purchase grants you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only during your active paid access period. You may not:

• Copy, share, distribute, reproduce, record (including live sessions), screenshot, or create derivative works from the Content.
• Resell, teach, or use the Content for commercial purposes or competing services.
• Share account access or disclose confidential group information.

Unauthorized use may result in immediate termination of access, legal action, damages, and forfeiture of fees. Report infringements to info@michellejlamont.com.

6. User Conduct and Community Guidelines You agree not to use the Services for illegal, harmful, or abusive purposes. In communities, live programs, or events, you must:

• Treat others respectfully and refrain from harassment, hate speech, solicitation, or disruption.
• Maintain confidentiality of other participants’ information.

We reserve the right to remove content or participants at our sole discretion for violations, without refund.

7. In-Person Services Specific Terms For in-person coaching, retreats, workshops, or events:

• You assume all risks of travel, participation, and activities; disclose any medical or physical conditions in advance.
• We may take photos/videos for promotional use; you consent unless you notify us in writing beforehand.
• You are responsible for your own travel, lodging, insurance, and compliance with local laws.
• Force majeure events (e.g., weather, illness, pandemics, travel restrictions) may lead to cancellation or rescheduling; see our Refund Policy for details.

8. Third-Party Platforms Services integrate with Thinkific, payment processors, Zoom, and other tools. You agree to comply with their terms. We are not responsible for third-party issues, downtime, or data breaches beyond our reasonable control.

9. Disclaimers THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RESULTS VARY BY INDIVIDUAL AND DEPEND ON YOUR EFFORTS AND CIRCUMSTANCES. NO GUARANTEES ARE MADE REGARDING SPECIFIC OUTCOMES, INCOME, BUSINESS RESULTS, OR PERSONAL TRANSFORMATION. TESTIMONIALS REFLECT INDIVIDUAL EXPERIENCES ONLY. YOU ARE SOLELY RESPONSIBLE FOR YOUR PARTICIPATION, DECISIONS, ACTIONS, AND RESULTS.

10. Limitation of Liability To the fullest extent permitted by law, our total liability (including affiliates and coaches) shall not exceed the amount you paid for the specific Service in question. We shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, data, or opportunities), even if advised of the possibility.

11. Indemnification You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, costs (including attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

12. Termination We may terminate or suspend your access at any time for violations, non-payment, misconduct, or at our discretion, with or without notice. Upon termination, your license to Content ends; you must cease use and delete copies. Sections that by nature survive termination (e.g., IP, Disclaimers, Limitation of Liability, Indemnification, Governing Law) continue in effect.

13. Governing Law and Dispute Resolution These Terms are governed by the laws of the United States, without regard to conflict of laws principles. Any disputes shall be resolved exclusively through binding arbitration in the United States under the American Arbitration Association (AAA) rules, or in small claims court if qualifying. For users in the EU/EEA or other jurisdictions, mandatory consumer rights under applicable local law are not affected.

14. Changes to Terms We may update these Terms with notice (via email, Site posting, or Thinkific). Continued use after changes constitutes acceptance.
